And the second thing we really need you to do before your party date is for the lead adult to sign the waiver form.
This Waiver and Release Agreement (“Agreement”) is made and entered into by and between UK Gaming Limited (“Company”) and the undersigned Party Organiser (“Organiser”).
1. Definitions
1.1 “Company” refers to UK Gaming Limited, trading as Hurricane Gaming Parties, including its employees, agents, and representatives.
1.2 “Organiser” refers to the individual signing this Agreement on behalf of all attendees of the event.
1.3 “Event” refers to the gaming party organised and managed by the Company.
1.4 “Attendees” refers to all individuals participating in the Event.
2. Acknowledgement and Assumption of Risk
2.1 The Organiser acknowledges that participation in the Event involves inherent risks including, but not limited to, damage to property, personal injury, serious injuries, permanent disability, and death.
2.2 The Organiser voluntarily assumes all risks associated with participation in the Event on behalf of all Attendees.
3. Description of Services and Activities
3.1 The Event may include, but is not limited to, the use of gaming equipment, simulation walk-throughs, training exercises, motion capture and tracking technology, wearable computing technology, wireless controllers, haptic feedback technology, head-mounted virtual reality displays, free roam untethered virtual reality simulation technology, equipment rental and maintenance, and use of recreation and waiting areas.
4. Liability Limitation
4.1 UK Gaming Limited, its employees, directors, and agents are not liable to the Organiser, attendees, their dependants, or legal representatives for personal injury or death suffered because the simulation activities were not supplied with due care and skill or were not reasonably fit for their purpose, or because of negligence, breach of contract, statute, or statutory duty by UK Gaming Limited.
5. Indemnity
5.1 The Organiser agrees to indemnify and defend UK Gaming Limited, its employees, directors, and agents against any loss, liability, cost, expense, or damages arising from or in relation to the entry by any person onto UK Gaming Limited premises or participation in their simulation activities.
6. Risk Warning
6.1 The use of tracking spaces, head-mounted virtual reality displays, free roam untethered virtual reality simulation technology, and other equipment at any UK Gaming Limited venue involves significant risk of personal injury, serious injuries, permanent disability, or death. All participants engage in these activities at their own risk.
7. Consumer Law and Fair Trading Act 2012
7.1 Under Consumer Law, several statutory guarantees apply to the supply of certain goods and services. These guarantees require that the Company ensures the recreational services it supplies:
- are rendered with due care and skill;
- are reasonably fit for any purpose made known to the supplier;
- might reasonably be expected to achieve any result made known to the supplier.
7.2 The Organiser agrees that their rights to sue the supplier under the Consumer Law & Fair Trading Act 2012 if they are killed or injured because the services were not in accordance with these guarantees are excluded, restricted, or modified in accordance with this Agreement.
8. Medical Emergencies
8.1 The Organiser agrees to pay the cost of and authorises UK Gaming Limited to take all steps it considers reasonably necessary to protect the welfare of any participant in the event of personal injury, including the administration of emergency medical treatment and ambulance transportation.
9. Age Restrictions and Parental Consent
9.1 If the participant is less than 18 years of age, this waiver must be co-signed by a parent or guardian. Participants aged 10-13 must be accompanied by a parent, guardian, or designated responsible adult over 18 to use the facilities at any UK Gaming Limited venue.
9.2 Participants aged 14-17 do not require parental or guardian supervision but must have a signed liability waiver to use the facilities at any UK Gaming Limited venue. In all circumstances listed above, the parent or guardian agrees to be bound by the conditions in the liability waiver on behalf of the minor.
10. Health Conditions
10.1 Participants agree they are in good health and free from any adverse medical conditions. For safety reasons, pregnant women, participants with pre-existing health issues, or those wearing casts are not permitted to use tracking spaces, head-mounted virtual reality displays, free roam untethered virtual reality simulation technology, or any other equipment. If in doubt, participants should seek medical advice.
11. Photographs and Media
11.1 The Organiser acknowledges that the Company may take photographs and videos during the Event for promotional purposes.
11.2 The Organiser consents to the Company using any photographs or videos that include images of Attendees, including those under the age of 18, for marketing and promotional purposes.
11.3 The Organiser agrees to obtain written consent from the parents or legal guardians of any Attendees under the age of 18 allowing their images to be used for promotional purposes.
12. Release and Indemnity
12.1 The Organiser, on behalf of all Attendees, releases, discharges, and holds harmless the Company from any claims, actions, damages, or liabilities arising out of or in connection with the Event.
12.2 The Organiser agrees to indemnify and defend the Company against any claims arising from the actions or omissions of the Organiser or any Attendees.
13. Governing Law
13.1 This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.
14. Entire Agreement
14.1 This Agreement constitutes the entire understanding between the Company and the Organiser with respect to the subject matter herein and supersedes all prior discussions, agreements, or understandings of any kind.
15. Severability
15.1 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
